These Terms & Conditions ("Terms") govern all mobile automotive services ("Services") provided by Birdie the Mobile Mechanic ("Provider") to any customer ("Customer") in Las Vegas, Nevada and surrounding areas. By booking, permitting work to begin, or accepting Services, the Customer agrees to these Terms. 1) Scope of Services Provider is an independent contractor offering on-site inspection, diagnostics, and repair where feasible under field conditions. Certain repairs may be unsafe or impractical to complete on-site. If Services cannot be completed on-site, Customer is solely responsible for arranging towing, shop repair, or other alternatives. 2) Estimates & Changes Any estimate is based on information available at the time of inspection and is not a guarantee of final cost. Actual conditions, parts availability, or additional issues discovered during Service may require changes in scope or price. Provider will communicate material changes before proceeding where practicable. 3) Payment Terms Payment in full is due immediately upon completion of the Services. Accepted payment methods: cash, card, or scanning the Provider’s QR code to an approved digital payment page (e.g., Zelle/Stripe/Pay link) provided at the time of service. Title to any installed parts transfers to Customer upon receipt of full payment. Provider may withhold return of vehicle keys until payment is received. Unpaid balances may be subject to lawful remedies, including applicable liens and recovery of reasonable collection costs and/or chargeback reversal fees where applicable. If a Customer is not present at the scheduled time and location or the vehicle is unavailable or inaccessible, any time spent onsite may be charged as a service call at Provider’s discretion. 5) Customer Responsibilities & Safety Customer must provide a safe, legal, and reasonably level location for Service; disclose known vehicle issues and modifications; and remove personal items that could obstruct work. Provider may refuse or stop work if 1 conditions are unsafe, unlawful, or likely to cause damage. Customer is responsible for all third-party costs (e.g., towing, parts pickup fees) unless otherwise agreed in writing. 6) Warranty; Disclaimer Unless expressly stated in writing, Services are provided "AS IS" with no warranties, express or implied, including any implied warranties of merchantability or fitness for a particular purpose. Provider does not warrant used or Customer-supplied parts. No assurance is made regarding future performance of the vehicle after completion of the Services. 7) Limitation of Liability To the fullest extent permitted by law, Provider’s total liability for any claim arising out of the Services is limited to the amount actually paid by Customer for the specific Service giving rise to the claim. In no event shall Provider be liable for indirect, incidental, special, or consequential damages, including loss of use, loss of time, or lost profits. 8) Parts & Customer-Supplied Parts Provider may use new, remanufactured, or equivalent parts. If Customer supplies parts, Provider’s responsibility is limited to proper installation where feasible; Provider provides no warranty on Customersupplied parts and may decline installation if parts are incorrect, unsafe, or inadequate. 9) Documentation Provider may create written records or photographs of the vehicle and work area for job documentation and safety. Such records may be retained for lawful business purposes. 10) Governing Law; Disputes These Terms are governed by the laws of the State of Nevada without regard to conflicts-of-law principles. The parties will first attempt in good faith to resolve disputes informally. If unresolved, claims may be brought in a court of competent jurisdiction located in Clark County, Nevada. $1 12) Service Call / Diagnostic Fee A non-refundable service call/diagnostic fee of $_____ is due upon arrival and covers travel and up to _____ minutes of on-site diagnosis. Additional diagnostic time is billed at $_____ per 15 minutes.
